These General Terms and Conditions of Umzugsservice Zürich GmbH – hereinafter referred to as “GTC” – set out the purchase of products and services of Umzugsservice Zürich GmbH. These GTC and the contract documents constitute the complete Agreement. They replace all previous verbal or written arrangements between the parties.

Article 1 – Obligations of Umzugsservice Zürich GmbH
Die Umzugsservice Zürich GmbH ist verpflichtet, angenommene Aufträge vertragsgemäß und mit notwendiger Sorgfalt auszuführen. Darüber hinaus muss die Umzugsservice Zürich GmbH bei Unkorrektheit der Objektdaten den Vertrag am Ausführungstag anpassen. Ansonsten besteht kein Anspruch auf Vertragsanpassung.

Article 2 – Obligations of the Client
The Client is obliged to make statements to the best of its knowledge and belief. In the event of deviations between the statements in the Contract and the details ascertained on-site, Umzugsservice Zürich GmbH may request an appropriate surcharge.

Article 3 – Prices
Prices are calculated at a flat rate/with a cost ceiling or based on an hourly rate. In that regard, the agreements in the Contract are binding. Prices include VAT and are in Swiss francs. We charge a minimum rate of 3 hours (4 hours for just one removal employee). We reserve the right to charge extra fees in high season, which will be included in the quote.

Subject to agreement, the expenses are as follows (the following services are additional services and are not included in the estimated cost):

  1. Packing and unpacking of the removal items, in particular packaging work that must be carried out by Umzugsservice Zürich GmbH on the date of removal
  2. The disassembly and assembly of complicated or new furniture that is particularly time-consuming or require the presence of a carpenter
  3. The transportation of refrigerators/chests over 200kg, pianos and other items with a tare weight of over 100kg
  4. The removal and fixture of pictures, mirrors, clocks, lamps, curtains, fittings etc.
  5. Additional costs for items that have to be transported via windows or balconies
  6. Customs clearance, duties and customs charges
  7. Additional expenses due to weather or in the case of blocked or broken roads meaning that the transport vehicle or furniture lift cannot be driven in front of the building; the same applies for transport vehicle and staff waiting time not caused by Umzugsservice Zürich GmbH

The costs depend on various factors: the size and furnishing of the home, our own contribution, distance from the old to the new place of residence and from the street to the building, the floor, the type of staircase, lift etc. We have put together this list of benchmark prices for you based on our many years of experience. Depending on the individual situation, they may be considerably more or considerably less.

Article 4 – Payment
Payments are to be made to the team leader in cash on the date of removal. Upon request of the Client, there is a possibility to settle the balance within 30 days by invoice, and without deduction. Payment against invoice only applies for amounts from CHF 1,000 – for the removal only. Payment for cleaning will always be made in cash on the date of the handover. In the case of failure to observe the 7-day deadline, the Client will be charged additional dunning costs.

Article 5 – Insurance
Transport insurance: CHF 100,000.- per delivery vehicle (may be increased if necessary), business liability insurance: CHF 5,000,000.-.

Article 6 – Withdrawal of the Client
In the event of any substantiated or unsubstantiated withdrawal within 14 calendar days before the moving date, a penalty of CHF 500.- will be charged.

Article 7 – Withdrawal of the Contractor
Umzugsservice Zürich GmbH may withdraw from the Contract for organisational reasons up to one month before the agreed date of removal at the latest. In the event of failure to observe this time period, it will be liable for any additional costs incurred.

Article 8 – Special agreements
Special agreements must be set out in writing in the Contract/quote. Any changes of ownership must be agreed in writing by all parties involved.

Article 9 – Liability
Umzugsservice Zürich GmbH is only liable for damage that is demonstrably caused by the negligence of its staff. Umzugsservice Zürich GmbH is only responsible for transported goods of which the packaging fulfils the normal transport requirements. Fragile items such as lamps, plants and technical equipment (televisions, hi-fi devices, computers) thus require suitable packaging. In the event that the content of removal boxes etc. is damaged, Umzugsservice Zürich GmbH is only liable if was packed and unpacked by its appointed assistants. The liability of Umzugsservice Zürich GmbH is limited to the costs for any repair work needed, or compensation for value reduction, subject to the exclusion of any claims for compensation. The liability of Umzugsservice Zürich GmbH begins upon acceptance of the goods and ends upon unloading at the destination.

Article 10 – Notice of defects
The Client is obliged to examine the cargo directly after unloading at the destination. Complaints must be communicated immediately to the team leader, and sent to Umzugsservice Zürich GmbH in writing within 3 days. After the expiry of this deadline, no more complaints or objections will be considered.

Article 11 – Data protection
Data that is shared with Umzugsservice Zürich GmbH for the purpose of order handling will be only used by the company to process the request as quickly as possible and in the most customer-friendly manner possible. The Contractor is obliged to protect personal data, observing the statutory provisions. For data processing, the provisions of the Federal Act on Data Protection (Bundesgesetz über den Datenschutz – DSG, Art. 235.1) apply.

Personal details may not be passed on to third parties without prior permission, revocable at any time.

Article 12 – Place of jurisdiction and applicable law
Any disputes resulting from this Contract are to be assessed according to Swiss law. The competent court for the assessment of any disputed claims between the two contracting parties is the Bezirksgericht (District Court) of Zurich.
